By installing, accessing, or using ReplyBot ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

ReplyBot is operated by ReplyBot ("we," "us," or "our"). These Terms govern your use of our Chrome extension and related services.

2. Description of Service

ReplyBot is a Chrome browser extension that provides AI-powered automatic responses to Facebook Marketplace messages. The Service includes:

Automatic detection of unread Marketplace conversations
AI-generated responses to buyer inquiries
SMS notifications for serious buyers (optional)
Activity logging and usage tracking

3. Eligibility

You must be at least 18 years old to use ReplyBot. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. Account and License

4.1 License Key

To use ReplyBot, you must obtain a valid license key. Your license key is personal to you and may not be shared, transferred, or sold to others.

4.2 Account Responsibility

You are responsible for maintaining the confidentiality of your license key and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

5. Acceptable Use

You agree to use ReplyBot only for lawful purposes. You may NOT:

Use the Service for any illegal or fraudulent activity
Use the Service to spam, harass, or deceive others
Attempt to circumvent usage limits or subscription restrictions
Reverse engineer, decompile, or disassemble the Service
Use the Service in ways that violate Facebook's Terms of Service
Share, resell, or redistribute your license key
Use the Service to send misleading or false information to buyers
Attempt to access other users' accounts or data

6. Subscription and Payment

6.1 Pricing Tiers

ReplyBot offers various subscription tiers with different usage limits. Current pricing and limits are displayed on our website and may change with notice.

6.2 Billing

Paid subscriptions are billed monthly or annually, depending on your chosen plan. Payment is processed by third-party payment providers.

6.3 Refunds

We offer a 7-day money-back guarantee for first-time subscribers. After this period, refunds are provided at our discretion. Contact support@dautidigital.com for refund requests.

7. Usage Limits

Each subscription tier includes a monthly limit on the number of AI-generated replies. Usage limits reset on the first day of each calendar month.

If you exceed your limit, the Service will stop generating automatic replies until your limit resets or you upgrade to a higher tier.

8. AI-Generated Content

8.1 Nature of AI Responses

Responses generated by ReplyBot are created using artificial intelligence. While we strive for accuracy and appropriateness, AI-generated content may occasionally contain errors or inappropriate responses.

8.2 Your Responsibility

You are solely responsible for the messages sent through your Facebook account, including those generated by ReplyBot. We recommend periodically reviewing the activity log to ensure responses are appropriate.

9. Third-Party Services

ReplyBot integrates with third-party services including:

Facebook: We access your Marketplace inbox through the Facebook website. You must comply with Facebook's Terms of Service.
AI Providers: We use third-party AI services to generate responses.
SMS Providers: We use third-party services to deliver SMS notifications.

We are not responsible for the availability, accuracy, or policies of third-party services.

10. Intellectual Property

ReplyBot and its original content, features, and functionality are owned by ReplyBot and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose, subject to these Terms.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Merchantability or fitness for a particular purpose
Uninterrupted or error-free operation
Accuracy or reliability of AI-generated responses
Compatibility with Facebook's platform changes

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REPLYBOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Lost sales or business opportunities
Account suspensions or bans on third-party platforms
Damages arising from AI-generated content
Loss of data or service interruptions

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless ReplyBot, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.

You may terminate your use of the Service at any time by uninstalling the extension and discontinuing use. Termination does not entitle you to a refund of any fees paid.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date and, where appropriate, providing additional notice. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ReplyBot operates, without regard to its conflict of law provisions.
